Pennsylvania workers often suffer hernia injuries from heavy lifting in their jobs.
Such injuries are often self-limiting (meaning the treatment can be quick and with a defined recovery time absent complications). Many employers push hard to have their employees treat such injuries outside of the Workers' Compensation Act, pressuring the injured worker to seek treatment through their family doctor or through their own health insurance even when the problem clearly arises from an injury at work. We had one recent client who hesitated to treat his work-related hernia injury as work-related after his employer pushed for him to seek treatment under private health insurance. When the employer learned the employee would need surgery and would be out for several weeks during the employer's busy season, the employer came up with an excuse and fired the employee. In the process, the worker lost his health insurance before he could get the surgery. He was left with no job, no access to surgery, no payment for lost wages, and a case somewhat complicated by the early medical treatment records that failed to explain that the injury had happened at work. The case took months to resolve, with the claimant stagnated in his ability to get the full treatment necessary in the interim.
Another hernia case resulted in a substantial six figure settlement -- contrary to the initial assumption by employers and insurance companies that hernia injuries are necessary short-term or self-limiting. Our client obtained a settlement valued at years of future wage loss compensation in hard-fought litigation, after two failed hernia surgeries left him with symptoms which prevented him from resuming his pre-injury career work with the involved employer.
Note also that even if you have previously been diagnosed with a hernia, predating your work injury, if you suffer a work injury that aggravates the hernia and makes it necessary for you to pursue surgery, this is a properly compensable workers compensation claim. Your employer is responsible for the aggravation injury and for the required surgery.
