When a Pennsylvania Workers' Compensation insurance company directs you to an IME ("independent medical examination" -- which we more accurately call an insurance medical examination), you pretty much have to go, if you are getting or trying to get workers' compensation benefits. If you fail to show up, bad things can happen. You could even lose your benefits, or at least be forced to appear in court to explain your failure to appear for the examination.
Still, there are times when showing for an IME would be unreasonable, or when missing the IME would be in your best interest. There are ways to protect yourself in such circumstances.
In many cases, if the insurance company just stops paying your benefits, only because you were a "no show" for an IME, they will be violating the Workers' Compensation Act. The big question of whether the insurance company can stop sending you checks without first getting a judge's order depends a lot on exactly where things stand with your claim. That is, your rights depend in a very big way on the procedural status of your claim. Even when a workers' comp insurance company cannot properly stop your benefits all on their own, they may petition a workers' compensation judge to stop your benefits if you fail to appear for their IME examination.
No matter how serious your injury may, and no matter how supportive your treating doctors may be in confirming your injury and resulting disability, you should be very cautious when you are scheduled for an IME. The IME physician is hand-picked by the insurance company, always with the intention of limiting or ending your claim. You may have a lot to lose with the result of an insurance-oriented IME. The timing of an IME can sometimes be very harmful to your rights. Therefore, the question of whether you can safely avoid or postpone that examination requires consideration and advice from a knowledgeable source.
In many circumstances, it may be unreasonable for the insurance company to insist you appear for an IME. Each of these will be very narrow and specific to the facts of your claim. However, the decision you reach on this question can have major consequences for your claim and your ability to successfuly fight for your rights.
