When a Pennsylvania Workers' Compensation insurance company directs you to an IME ("independent medical examination" -- which we more accurately call an insurance medical examination), you pretty much have to go, if you are getting or trying to get workers' compensation benefits. If you fail to show up, bad things can happen. You could even lose your benefits, or at least be forced to appear in court to explain your failure to appear for the examination.
Still, there are times when showing for an IME would be unreasonable, or when missing the IME would be in your best interest. There are ways to protect yourself in such circumstances.
In many cases, if the insurance company just stops paying your benefits, only because you were a "no show" for an IME, they will be violating the Workers' Compensation Act. The big question of whether the insurance company can stop sending you checks without first getting a judge's order depends a lot on exactly where things stand with your claim. That is, your rights depend in a very big way on the procedural status of your claim. Even when a workers' comp insurance company cannot properly stop your benefits all on their own, they may petition a workers' compensation judge to stop your benefits if you fail to appear for their IME examination.
No matter how serious your injury may, and no matter how supportive your treating doctors may be in confirming your injury and resulting disability, you should be very cautious when you are scheduled for an IME. The IME physician is hand-picked by the insurance company, always with the intention of limiting or ending your claim. You may have a lot to lose with the result of an insurance-oriented IME. The timing of an IME can sometimes be very harmful to your rights. Therefore, the question of whether you can safely avoid or postpone that examination requires consideration and advice from a knowledgeable source.
In many circumstances, it may be unreasonable for the insurance company to insist you appear for an IME. Each of these will be very narrow and specific to the facts of your claim. However, the decision you reach on this question can have major consequences for your claim and your ability to successfuly fight for your rights.
For these reasons, it is essential that you get advice from a competent attorney who is recognized as a specialist in workers' compensation law as soon as you get word you may be scheduled for an independent medical examination.
Call my office today for a free consultation. I can explain how I can help. If you decide to retain me as your attorney, I can guide you through all decisions relating to the IME. Better still, I don't charge a penny for such advice and guidance. In fact, my fee is based only on securing rights for you in litigation where the insurance carrier actively fights you in court trying to limit your rights or where we secure a lump sum settlement on terms you fully approve -- that is a contingent fee, which we will recover only if and when we secure benefits for you.
The earlier you call us, particularly before an IME, the more we can do to protect your rights. The sooner you call us, the stronger your claim will be, since you will have the benefit of advice and guidance from someone who knows how to make the most of your rights and how to fight back when the insurance company tries to manipulate those rights to their advantage.
Please call me, Attorney Tim Kennedy, the Pennsylvania workers' compensation law specialist, at 484-453-8144 to learn more.
I had a serious work related injury. I hired Tim after speaking with him and feeling completely at ease with his professionalism and demeanor. My case became complicated over time. Throughout the process I always felt that Tim had my best interest in mind. With every phone call or email, Tim was very informative and proactive, always explaining things in a way I could understand. He worked hard for me in his dealings with my employers insurance company. He did this so much so, the insurance company actually fired their own attorneys in the middle of litigation. In the end, Tim was able to negotiate a substantial settlement, including taking the burden off of me of an excessive amount of unpaid medical bills. I would highly recommend Tim.

Timothy is a really great lawyer. He knows what to do, and how to handle really sticky situations. When I first came to him, I had very little to back me up, but we mainly him lol pulled through and got the job done with GREAT results. If I could back in time I would still pick him as a lawyer 1000 times more. He took his time, talk to me like I was a person and not a dollor sign, and made lawyer jargon understandable english for me. I truely felt comfortable with him handling my case, and I never doubted him since the very first meeting. I also like that he gives his personal direct number to get in contact with him whenever you may need him, and he always responds if not that same day, the very next. The only bad thing I would have to say is its a shame I would have legal trouble to work with him again lol.

When hiring a lawyer you need to be sure that they are knowledgeable, trustworthy, responsive and most of all have very strong confidence in their abilities to fight for your rights. Mr. Kennedy is one of the most confident people i know. He is determined and aggressive. I guess i can also say he is feared by others. Mr. Kennedy made me feel as we were friends by always keeping me informed and also asking me for my input as well as cared for my opinion. He told me that he would have no problem getting me the amount that i felt i deserved. He then said i will do better than that were gonna go high and mabey hit a homerun. When he called me with news of the final judgement i was shocked he said i not only hit a homerun for you, it was a grandslam. His work is so impressive he can be considered to be the best in PA.
