If you have been hurt at work in an office environment, you may suffer special challenges under the Pennsylvania Workers Compensation Act.  You may be faced with the difficulty of proving that a repetitive strain injury -- such as carpal tunnel sydrmome -- really is work-related.  You may have fallen at work, resulting in severe injury, only to have your co-workers or supervisors make light of your resulting disability.  You may be faced with employer-referred doctors who immediately think that because your job does not involve heavy labor, you should be instantly ready for a return to work -- even if you can't concentrate due to pain or due to the effects of necessary medications, or even if you cannot drive to work due to your injury.

Often, office employers are less aware of their own obligations and duties under the Workers' Compensation Act than employers in more "high risk" fields involving more physical labor.  This can mean that employers don't comply with the law -- which can work dramatically against you if you simply allow the employer to handle things as they fit. But where your employer is not meeting its obligations, this can also present opportunities for the injured worker who has immediate advice from a certified workers' compensation law specialist.  For example, while your employer or their insurance representatives may claim they have the right to force you to treat with only their carefully selected, highly biased and insurance-oriented doctors, this is only true if your employer has met certain obligations under the Act, which very often employers of office or clerical workers simply fail to do.  This can give you the right to treat with doctors of your own choice, who will almost certainly be more sympathetic and supportive of your symptoms than an employer-referred doctor interested only in pushing you back to work.  How your employer handles this issue, and how you respond, determines who will have control over the early medical evidence in your case, just as surely as it determines who will have control over treatment decisions.

And when it comes to the employer pushing you back to work too soon after an injury, you need advice and guidance from a competent source so that you can see all of the angles before you risk worsening your injury with a too early return to work, or before you risk harming your own rights by refusing a light duty assignment when you may lack the proper evidence to support that decision.
